I. Call to Order/ Opening Business. PNB Chair Grace Aaron called meeting to
order at 8:17 pm (ET). Shawn O'Brien served as timekeeper.

a. Roll Call/ Quorum. Carolyn Birden called the roll and a quorum was
established. Staff Recording Secretary, Richard Uzzell joined the call
shortly afterwards.

b. Agenda Approval. Chair asked if there were any additions or changes
proposed for the Agenda. O'Brien moved the approval of the Agenda.
HNO, Agenda Approved.

c. Minutes. O'Brien moved that considration of any Minutes be
postponed until up- coming In-Person meeting. HNO motion
Approved.

II. Acknowledgements.

** Bonnie Simmons for her work (the past 9 years) as on of the four
producters
for the "Hardly Strickly Blue Grass Festival;" a free
concert in Golden Gate Park
w/Friday for school children. **

III. a. Arbitration Agreement. Aaron reported that the feedback requested
at the Sep. 25, 2009 PNB meeting re: GM response to the proposed agreement
was that the GMs, the Affiliates Director, the Archives Director and the
Technology Director all agreed that this policy would be a good idea.
Aaron moved that from this date forward, October 4, 2009; signing an
Arbitration Agreement will be a prerequisite for all management hires.
Motion voted Approved, 9-6-1. [See Below.]

b. Recall Election Issue At KPFA. When the PNB passed the recently
approved Recall Election Policy (Sep. 3, 2009), a subsequent motion by
Reiter stated that "the PNB Delegate Recall Procedures shall be used to
conduct existing recall elections; except for the current election at
KPFA, where the procedure, shall begin at section 2."

Several PNB members asked for a legal opinion of whether two
recalls may be dealt with
Differently. Ricardo deAnda began his report.

Young called a Point of Order re: comments
being made by the Counsel do not address the question
of "how can two recalls be dealt with
differently. No ruling made.

Time expired. Young moved to extend time for five minutes.
HNO, motion Approved.

Young moved that, based on what our attorney advised, that 1.
seeking legal advice is the appropriate threshold, and 2. that
differentating between these two situations is ill-advised; and therefore
move to recind the above mentioned motion that would exempt the KPFA
Recall from the adopted procedure. There was a question of proper notice
to recind. It was determined that Schroell had provided sufficient
notice.

Time expired. O'Brien moved to extend time for five minutes.

IV. National Election Supervisor's Report and Motion from Election
Committee.

NES Report. NES, Les Radke gave his report. [Audio available

Election Committee Report w/ Motions. Committee member Caroyln Birden
presented a report then presented the five motions. Time expired for the Open
Session. Radford moved to extend for 30 minutes. Motion voted Approved, 13-2-
2.

Motion 1. The Elections Committee recommends that the LES/NES consider
disruptions of Pacifica's meetings or events as possible grounds for
disqualification.

Motion 2. At any station at which there is reason to believe that a
significant number of voters did not receive a ballot, a postcard should
be immediately mailed to the entire membership with Address Correction
Requested. The postcard should ask anyone who has not received a ballot to
contact the LES. The voters whose postcards bounce should be mailed a
second ballot to the corrected address, or if no corrected address be
available, that voter should be contacted by phone or email to get a
corrected address.


R. Ross moved to disregard the motion. HNO motion to disregard Approved.

Motion 3. The Election Committee requests that the PNB send out a
directive to all LESes to produce and air ANNOUNCEMENTS that instruct
members what to do if they have not received a ballot, as well as,
encourage voters to return their ballots, and that all such ANNOUNCEMENTS
be put into regular and repeated rotation until October 15th, 2009.
Further, that all Pacifica website be updated to provide information for
requesting ballots.


HNO [Gendelman Abstained] Motion Approved.


Motion 4. The PNB Elections Committee recommends that the PNB ask the
National Election Supervisor to immediately correct the Pacifica website
and any Pacifica station websites that have a deadline for returning
Delegate election ballots that differs from the deadline printed on the
ballots. Motion MOOT.

Motion 5. This committee recommends to the PNB Chair to immediately send
a letter to the NES requesting that he address all of the issues expressed
tonight and report back to the PNB his resolution of these issues
including: (1) Non enforcement the unfair campaign rule; (2) Mailing of
ballots, AND THAT THE CHAIR ASK THE NES TO MEET WITH THE ELECTIONS
COMMITTEE NEXT WEEK OR AS SOON AS POSSIBLE. HNO, Motion was referred to
Election Committee.
